General Terms and Conditions
1. Scope
The following terms and conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
For Germany, the following applies: Consumers are, according to § 13 BGB, any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
For Austria, the following conditions apply: In the following terms, "consumer" is to be understood as the "consumer" within the meaning of the Consumer Protection Act (KSchG).
For Switzerland, the following conditions apply: In the following terms, "consumer" is to be understood as the "consumer" under Swiss law.
2. Contracting parties, conclusion of contract, correction options
The purchase contract is concluded with Doctor Mi! GmbH.
By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email once again.
3. Contract language, contract text storage
The language(s) available for concluding the contract: German, English
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Delivery Conditions
4.1 Shipping costs
The standard shipping is free of charge for orders with a value of 50 EUR including VAT.

You basically have the option to pick up at Doctor Mi! GmbH - HOUSE OF MI!, Widenmayerstraße 31, 80538 Munich, Germany during the following business hours: Mon - Thu from 10 AM to 5 PM, Fri from 10 AM to 3 PM
5. Payment
5.1 Prices
The prices specified at the time of the order apply. These are total prices and include the statutory value-added tax.
5.2 Due Date and Payment Default
The price is due upon conclusion of the contract, unless a later date results from the following payment terms.
For customers based in Germany and Austria, the following applies:
- Towards consumers: In the event of a payment default, we reserve the right to charge you a fee of 1.50 euros per reminder for the second and each subsequent reminder. You retain the right to prove that a lesser damage has occurred. Further claims remain unaffected by this.
- To entrepreneurs: In the event of a payment default, we reserve the right to charge you the statutory default interest at a rate of nine percentage points above the base interest rate as well as a flat fee of 40 euros. Further claims remain unaffected by this.
For customers based in Switzerland, the following applies:
- Towards consumers: In the event of a payment default, we reserve the right to charge you a fee of 1.50 CHF per reminder for the second and each subsequent reminder. You retain the right to prove that a lesser damage has occurred. Further claims remain unaffected by this.
- To the entrepreneur: In the event of a payment default, we reserve the right to charge you default interest at a rate of nine percentage points above the ECB base rate as well as a flat fee of 40 CHF. Further claims remain unaffected by this.
5.3 Payment methods
In our shop, the following payment methods are generally available to you.
Prepayment
If you choose the payment method advance payment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
credit card
During the ordering process, you enter your credit card details. Your card will be charged immediately after placing the order.
PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after placing the order. Further information is provided during the ordering process.
PayPal can offer additional payment methods in the customer account to registered PayPal customers selected according to its own criteria. However, we have no influence on the offering of these methods; further individually offered payment methods concern your legal relationship with PayPal. You can find more information about this in your PayPal account.
Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, identify yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. Further information is provided during the ordering process.
Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.
giropay
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M, we offer the payment method giropay. To be able to pay the invoice amount via giropay, you must have a bank account enabled for online banking, identify yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is provided during the ordering process.
Giropay can offer registered and selected giropay customers additional payment options in their customer account based on its own criteria. However, we have no influence on the offering of these options; any further individually offered payment options concern your legal relationship with giropay. pay direct
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M, we offer the payment method paydirekt. To be able to pay the invoice amount via paydirekt, you must have a bank account enabled for online banking, identify yourself accordingly, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.
Paydirekt can offer registered and selectively chosen paydirekt customers additional payment methods in their customer account based on its own criteria. However, we have no influence on the offering of these methods; any further individually offered payment methods concern your legal relationship with paydirekt. Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise specified below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information can be found with the respective payment option and in the ordering process.
Purchase on account via Klarna
The invoice amount is due 30 days after the shipment of the goods and receipt of the invoice.
Klarna can offer additional payment options in the customer account to registered Klarna customers selected according to its own criteria. However, we have no influence on the offering of these options; any further individually offered payment options concern your legal relationship with Klarna. You can find more information about this in your Klarna account.
Installment purchase via Klarna
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment amount is 6.95 euros.
Klarna can offer registered and selected Klarna customers additional payment options in their customer account (e.g., interest-free installment plans) based on its own criteria. However, we have no influence on the offering of these options; any further individually offered payment options concern your legal relationship with Klarna. Klarna credit card
During the ordering process, you enter your credit card details. Your card will be charged by Klarna immediately after placing the order. No address or credit check will be conducted.
Klarna direct debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you about the date of the account debit (so-called prenotification). The account debit takes place after the shipment of the goods.
6. Retention of title
The product remains our property until full payment is made.
For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.
7. Transport damages
If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.
8. Warranty and Guarantees
8.1 Warranty Liability Law
The statutory warranty law applies.
For consumers based in Switzerland, the following applies:
You are required, as soon as it is feasible according to usual business practices, to inspect the condition of the received item and, if defects are found for which the seller is liable, to notify the seller immediately. If the consumer fails to do this, the purchased item is considered approved, except for defects that were not detectable during proper inspection. If such defects appear later, notification must be made immediately after discovery; otherwise, the item is also considered approved with respect to these defects.
Send the defective product back to us with a description of the defect. You bear the transport costs incurred. We provide warranty by remedying defects. This is done at our discretion either by eliminating the defect (repair) or by delivering a defect-free item (replacement delivery). If the subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a price reduction is excluded.
8.2 Warranties and Customer Service
Information about any additional warranties that may apply and their exact conditions can be found for each product and on special information pages in the online shop.
Customer Service: You can reach our customer service for questions, complaints, and objections Monday - Thursday from 9:30 AM to 5:30 PM and Friday from 9:30 AM to 3:00 PM by email at support@doctormi.de.
9. Liability
For claims arising from damages caused by us, our legal representatives, or vicarious agents, we are always fully liable.
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of warranty promises, as agreed, or
- as far as the scope of application of the Product Liability Act is concerned.
In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which typically must be expected to occur.
Claims for damages are excluded, by the way.

11. Agreement on the Use of Trusted Shops Buyer Protection
You can secure orders placed with us free of charge up to a certain order value through the buyer protection of Trusted Shops SE. In addition, Trusted Shops, together with a guarantor, offers a paid protection. The Trusted Shops buyer protection conditions apply, which you can find here. The conclusion of the buyer protection takes place by clicking on the appropriately labeled button of the so-called Trustcard, which appears as a pop-up on the order thank-you page after placing an order. If you are already registered for buyer protection, your order will be automatically secured (automatic buyer protection) without you having to click the button. To offer you the (automatic) buyer protection, the Trustcard must access order data stored in the cache of your browser. For this purpose, a hash value of your email address as well as the order number and order total are transmitted to Trusted Shops. If you are already registered for buyer protection, your order will be automatically secured. If you are not yet registered for buyer protection, you can register as described above via the Trustcard. 12. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
Should individual clauses of these Terms and Conditions be wholly or partially invalid, the contract shall remain effective in all other respects. Insofar as individual clauses are invalid, the content of the contract shall be governed by statutory provisions.
